Homh, LLC and its affiliates (collectively "Homh," "we," "our," or "us") value your privacy. In this Privacy Policy ("Policy"), we describe the information we collect, how we use it, and when and to whom we disclose it. This Policy applies to your use of Homh.com designed to facilitate the booking of Professional Services by Users, including its website, any associated mobile application, and other online services (collectively, the "Marketplace") made available by or through Homh and on which we post this Policy, including through our URL www.homh.com, and to information we collect offline or through other means. By accessing or using the Marketplace, you agree to this Policy. IF YOU DO NOT AGREE TO THIS POLICY, PLEASE DO NOT ACCESS OR USE THE MARKETPLACE.

KEY TERMS

"Professional Services" means the variety of professional services offered on the Marketplace by Professionals.

"Professionals" means professional service providers who list, schedule, offer, provide, fulfill, or facilitate the provision of a variety of Professional Services.

"User" means persons or entities wishing to search for, book, purchase and/or receive certain professional services through the Marketplace. Once a User becomes a customer of a Professional, the User will also be subject to the terms and policies of the Professional, and those terms and policies, and not Homh's, will govern the Professional's provision of services.

INFORMATION WE COLLECT

How we collect and store information depends on how you access and use the Marketplace. We collect information in multiple ways including when you provide information directly to us, when we collect information from affiliates and non- affiliated sources, and when we passively collect information from you, such as information collected from your browser or device.

Information You Provide Directly to Us

You may provide us with information when you use or access the Marketplace, such as when you register for an account; request information about available Professionals; submit or respond to a quote; fill out any forms; participate in a survey; or otherwise communicate with us or other Users or Professionals through the Marketplace. This list is illustrative, not exhaustive; this Policy applies to all your uses of the Marketplace.

The information you provide directly to us may include, but is not limited to:

• Personal contact information, such as your name, address, email address, phone number.
• Business information, including your company name, title, role, business address, business phone number, and business email address, prior job experience, business ratings and reviews, as well as information about the services and Professionals your business provides.
• Information about the services you are requesting, which could include information about the type of project you are seeking a Professional for and your related project needs.
• Financial/payment information, if you use a paid portion of the Marketplace (note that we utilize a third-party payment provider to process payment information (e.g., credit card information or bank account information)).
• Other information, which includes any other information you provide in communications with us or through the Marketplace, such as any additional demographic or other information you include in a Marketplace profile.

Information from Affiliates and Other Non-Affiliated Sources

To the extent permitted by law, we may, in our sole discretion, ask for and collect supplemental information about you from non-affiliated sources, such as information to verify your identity, or for other fraud or safety protection purposes. If you are a Professional, we will also collect information about your business from various publicly available sources to create your business profile on the Marketplace, which may include reviews and ratings from third-party platforms such as Google. Moreover, if you are a Professional that is also a customer of other ServiceTitan products and services, we may collect additional information (such as count of completed services and number of years in business) from your use of such other products and services.

We may combine information that we collect from you through the Marketplace with information that we obtain from such sources, including public information sources and information derived from any other products or services we provide. Please note that we have no control over how any third-party site uses or discloses the information it collects about you.

Information That Is Passively or Automatically Collected Device/Usage Information.

We and certain third-party vendors, including analytics providers, may use cookies, web beacons, and other tracking technologies to collect information about the computers or devices (including mobile devices) you use to access the Marketplace. As described further below, we and these third-party vendors may collect and analyze information including but not limited to (a) browser type; (b) ISP or operating system; (c) domain name; (d) access time; (e) referring or exit pages; (f) page views; (g) IP address; (h) unique device identifiers (e.g. IDFA or Android ID); and (i) the type of device that you use. We use this information (including the information collected by relevant third-party vendors) for Marketplace analytics (including to determine which portions of the Marketplace are used most frequently and what our Users like/do not like), product improvement, and similar business purposes.

Location Information. When you use the Marketplace, we may collect general location information (such as your location as derived from your IP address or your zip code disclosed in connection with seeking services).

Cookies and Other Electronic Technologies. We and our third-party vendors may use cookies, clear GIFs, pixel tags, and other technologies that help us better understand User and Professional behavior on the Marketplace, personalize preferences, perform research and analytics, and improve the Marketplace. These technologies, for example, may allow us to tailor the Marketplace to your needs, save your password in password-protected areas, track the pages you visit, help us manage content, and compile statistics about Marketplace usage. These technologies may also collect information such as mouse movements, click stream data, scrolls, and navigation patterns.

You can choose to accept or decline cookies. Most web browsers automatically accept cookies, but your browser may allow you to modify your browser settings to decline cookies if you prefer. If you disable cookies, you may be prevented from taking full advantage of the Marketplace, because it may not function properly. As we adopt additional technologies, we may also gather additional information through other methods.

HOW WE USE YOUR INFORMATION

We use your information for any of the following reasons:

• To enable you to use the services available through the Marketplace, including registering you for our services;
• To communicate with you in response to your requests for services through the Marketplace, which may occur via email, phone call, or SMS message.
• For customer support and to respond to your inquiries;
• To administer surveys, sweepstakes, promotions, or contests;
• To improve and maintain the Marketplace and for product development;
• To address fraud or safety concerns, or to investigate complaints or suspected fraud or wrongdoing;
• To market and advertise our services and the Marketplace, including to send promotional emails regarding new products from Homh, special offers from Homh, or other information that may interest you;
• For Homh's analytics and market research purposes, including, but not limited to, the customization of the Marketplace according to your interests;
• To contact you with information about your use of the Marketplace; and
• To resolve disputes, to protect ourselves and other Users and/or Professionals of the Marketplace, or third parties, including to protect property or safety; and to enforce any legal terms that govern your use of the Marketplace.

If you are a Professional, we will also display information related to your business, including your name or your business's name, publicly available business rating, publicly available reviews, count of completed services, available appointment windows, years of business, and other similar information publicly on your profile. We will use review scores, number of completed jobs, availability, and price to determine how to display and rank your profile in search results.

Data combination. We may combine information that we collect from you through the Marketplace with information that we obtain from affiliated and non- affiliated sources, and information derived from any other products or services we provide.

Data de-identification. We may aggregate and/or de-identify information we collect. We may use de-identified or aggregated information for any purpose, including without limitation for research and marketing purposes and may also disclose such information to any third parties, including without limitation, advertisers, promotional partners, sponsors, event promoters, and/or others.

HOW WE DISCLOSE YOUR INFORMATION

Unless otherwise described in this Policy, we may also disclose the information that we collect as follows:

• Affiliates. We may disclose your information to Homh affiliates.
• Professionals. When you submit a request for services through the Marketplace, we will disclose your request to a limited number of available and relevant Professionals in your area. Once you select a Professional, we will also disclose your booking information, which includes your contact information, to the Professional. Further communications with the Professional will then be handled directly with the Professional.
• Vendors. We may provide your information to select third parties who perform services on our behalf. These third parties provide a variety of services to us including without limitation billing, sales, marketing, advertising, market research, fulfillment, data storage, analysis and processing, identity verification, fraud and safety protection and legal services.
• Legal Requirements. We may disclose your information when required by law or when we believe in good faith that such disclosure is necessary to: (a) comply with subpoenas, court orders, or other legal process we receive; (b) establish or exercise our legal rights including enforcing and administering agreements with Users and Professionals; or (c) defend Homh against legal claims. While you may challenge the disclosure request, please be advised we may still be legally required to turn over your information.
• Protection of Homh and Others. We may disclose your information when we believe it appropriate to investigate, prevent, or take action regarding possible illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of the Terms of Use or any other legal terms governing use of the Marketplace, and/or to protect our rights and property and the rights and property of others.
• Business Transfers. As we continue to develop our business, we may sell, buy, merge or partner with other companies or businesses, or sell some or all our assets. In such contemplated or actual transactions or where there is any change of control of Homh, your information may be among the disclosed and/or transferred assets.

ONLINE ANALYTICS AND ADVERTISING

We may use third-party web analytics services on the Marketplace, such as Google Analytics. Providers of these services use cookies and similar technologies (as described in the Information That Is Passively or Automatically Collected section above) to help us analyze how Users and Professionals use the Marketplace, including by noting the third-party website from which you arrive. The information collected by the technology may be disclosed to or collected directly by these providers.To prevent Google Analytics from using your information for analytics, you may install the Google Analytics Opt-Out Browser Add-on.

Tailored Online Advertising.

We allow select third party advertising technology partners to place cookies or other tracking technologies on the browser of your device to collect information about you as discussed above as you use the Marketplace. These third parties (e.g., ad networks and ad servers such as Google) may use this information to serve relevant content and advertising to you as you browse the Internet, and may access their own cookies or other tracking technologies on your browser to assist in this activity. For more information about these online advertising activities, and how you can generally control cookies from being put on your computer to deliver tailored advertising, you may visit the Network Advertising Initiative's Consumer Opt-Out link or the Digital Advertising Alliance's Consumer Opt-Out link to opt-out of receiving tailored advertising from companies that participate in those programs. We do not control these opt- out links or whether any particular company chooses to participate in these opt-out programs. We are not responsible for any choices you make using these mechanisms or the continued availability or accuracy of these mechanisms. Please note that if you use these mechanisms, you may still see advertising on our Marketplace or across the Internet, but it will not be tailored to you based on your online behavior over time.

PRIVACY OF MINORS

Our Marketplace is not directed to minors (i.e., persons under the age of 18). We elect to provide services only to persons 18 years of age or older, including any use of the Marketplace. If we discover, or if you inform us, that an individual under 18 has provided us with personal information, we will close the account and delete that individual's personal information as required by law, including the Children's Online Privacy Protection Act. We may, where permitted by law, retain certain information internally for purposes described in this Policy.

SECURITY AND RETENTION

Security. We employ physical, procedural, and technological security measures to help protect your information from unauthorized access or disclosure, such as encryption, passwords, and physical security measures to help protect your information against unauthorized access and disclosure. No security measures, however, are 100% failsafe. Therefore, we do not promise and cannot guarantee, and thus you should not expect, that any information provided or transmitted online is completely secure. You should take steps to protect against unauthorized access to your password, phone, and computer by, among other things, signing off after using a shared computer, choosing a robust password that nobody else knows or can easily guess, keeping your log-in and password private, and not recycling passwords from other websites or accounts. Homh is not responsible for the unauthorized use of your information nor for any lost, stolen, or compromised passwords, or for any activity on your account via unauthorized password activity.

Retention. We will retain your information for as long as reasonably necessary to provide the Marketplace and our services or until you delete or modify your information. We also reserve the right to retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

LINKS TO EXTERNAL SITES AND SERVICES

The Marketplace may contain links to third-party websites or services over which Homh does not have any control; please review such other websites' privacy policies as to their use of your information. Such links do not constitute an endorsement by Homh of those third-party websites. You acknowledge that Homh is providing these links to you only as a convenience, and further agree that Homh is not responsible in any way for such third-party websites, including without limitation for their content or how they treat information you provide to them.

YOUR CHOICES

Rights Regarding Your Information. Depending on your jurisdiction of residence (including California, Connecticut, Colorado, Delaware, Iowa, Indiana, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, Virginia and other U.S. states with similar privacy laws), you may have the right, in accordance with applicable data protection laws, to make requests related to your “personal information” or “personal data” (as such terms are defined under applicable law, and collectively referred to in this section as “personal information”). Specifically, you may have the right to ask us to:

• Inform you about the categories of personal information we collect or disclose about you; the categories of sources of such information; the business or commercial purpose for collecting your personal information; and the categories of third parties to which we disclose personal information;
• Provide you access to and/or a copy of personal information we hold about you;
• Correct or update personal information we hold about you;
• Delete personal information we have about you;
• Restrict or object to certain uses of your information; or
• Opt you out of the processing of your personal information for purposes of profiling in furtherance of decisions that produce legal or similarly significant effects, if applicable.

In addition, Oregon, Connecticut, and Minnesota residents can request a list of the specific third parties, other than natural persons, to which we have disclosed information.

Please note that certain information may be exempt from such requests under applicable law. For example, we need certain information in order to provide the Marketplace to you or comply with applicable law. We may take reasonable steps to verify your identity before responding to a request, which may include, at a minimum, depending on the sensitivity of the information you are requesting and the type of request you are making, verifying your name and email address. If we are unable to verify your identity, we may be unable to respond to your requests. As provided in applicable law, you also have the right to not be discriminated against for exercising your rights.

To exercise any of these rights, you can reach us by using this form or by emailing us at privacy@homh.com. You may be able to designate an authorized agent to make requests on your behalf. In order for an authorized agent to be verified, you must provide the authorized agent with signed, written permission to make such requests or a power of attorney. We may also follow up with you to verify your identity before processing the authorized agent's request as permitted by applicable law.

Depending on applicable law (Colorado, Connecticut, Delaware, Iowa, Indiana, Kentucky, Maryland, Minnesota, Montana, Oregon, Nebraska, New Hampshire, New Jersey, Rhode Island, Tennessee, Texas, or Virginia), you may have the right to appeal our decision to deny your request, if applicable. We will provide information about how to exercise that right in our response denying the request. You may also have the right to lodge a complaint with a supervisory authority.

Notice of Right to Opt Out of Sales of Personal Information and Processing/Sharing of Personal Information for Targeted Advertising Purposes. If you are located in any of the U.S. states identified above, you may also have the right to opt out of “sales” of your personal information and “sharing/processing of your information for targeted advertising.”

As explained in the “Online Analytics and Advertising” section above, we may provide your information to vendors that perform services to assist us in online advertising activities and in analyzing use of our Marketplace. Under applicable law, the disclosure of your personal information to these third parties for these purposes may be considered a “sale” of personal information or the “sharing” or “processing” of your personal information for online targeted advertising.

If you would like to opt out of the disclosure of your information to such third parties through cookies and similar tools for purposes that could be considered “sales” or “online targeted advertising” for those third parties' own commercial purposes, please click the 'Do Not Sell or Share My Personal Information' link in our website footer. Note that you will need to opt out on each device you use to access the Marketplace. If you have a legally recognized browser-based opt out preference signal turned on via your device browser, we recognize the preference expressed by such signal in accordance with applicable law.

CHANGES TO THIS POLICY

THIS POLICY IS CURRENT AS OF THE EFFECTIVE DATE SET FORTH ABOVE. HOMH MAY, IN ITS SOLE AND ABSOLUTE DISCRETION, CHANGE THIS POLICY AT ANY TIME. HOMH WILL POST ITS UPDATED POLICY ON THE MARKETPLACE, SEND YOU A MESSAGE OR OTHERWISE NOTIFY YOU WHEN YOU ARE LOGGED INTO YOUR ACCOUNT. HOMH ENCOURAGES YOU TO REVIEW THIS POLICY REGULARLY FOR ANY CHANGES. YOUR CONTINUED ACCESS TO OR USE OF THE MARKETPLACE WILL BE SUBJECT TO THE TERMS OF THE THEN-CURRENT POLICY.

CONSENT TO TRANSFER

Our Marketplace is currently based in the United States, so your information will be processed by us in the United States, where data protection and privacy regulations may not offer the same level of protection as in your country of residence. If you create an account with the Marketplace as a visitor from outside the United States, by using the Marketplace, you agree to this Policy and you consent to the processing of all such information in the United States.

SUPPLEMENTAL PRIVACY NOTICE FOR CALIFORNIA RESIDENTS

This Supplemental Privacy Notice for California Residents supplements the information in the Policy above, and except as provided herein, applies solely to California residents (as defined by the California Consumer Privacy Act (as amended, the “CCPA”)). It applies to “personal information” (as defined by the CCPA) that we collect on or through the Marketplace and through other means (such as information collected offline, in person, and over the telephone). It does not apply to business information that does not constitute personal information we collect from Professionals in their capacity as Professionals. This Supplemental Privacy Notice for California Residents also does not apply to current or former employees of Homh, LLC, independent contractors, or job applicants to jobs at Homh, LLC.

How We Collect, Use, and Disclose Personal Information

The CCPA requires us to disclose information regarding the categories of personal information and sensitive personal information that we have collected about California consumers, the categories of sources from which we collect personal information, the business or commercial purposes (as each of those terms is defined by the CCPA) for which we collect personal information, and the categories of parties to whom we disclose personal information.

Throughout this Policy, we describe the specific pieces of personal information and sensitive personal information we collect, the sources of that information, and how we disclose it. Under the CCPA, we also have to provide you with the "categories" of personal information and sensitive personal information we collect and disclose for “business or commercial purposes” (as those terms are defined by the CCPA). Please see the “Information We Collect,” “How We Use Your Information,” and “How We Disclose Your Information” sections above to receive these details.

The descriptions above provide information about our practices in the 12 months leading up to the effective date of this Policy in relation to the categories of personal information that we generally collect from California residents, the sources of the information, the purposes for which we use the information, and the categories of third parties to whom we disclose personal information for a business purpose.

The categories of personal information we “sell” or “share” for these purposes are identifiers, internet or other electronic network activity, commercial information, and inferences drawn from the foregoing. We “sell” or “share” these categories with advertising networks, analytics providers, and similar third-party advertising technology providers.

In the limited circumstances that we process sensitive personal information as defined in the CCPA (such as account log-in credentials), we do not use or disclose it other than for disclosed and permitted business purposes for which there is not a right to limit under the CCPA.

Your CCPA Rights

If you are a California resident (as defined by the CCPA), you may have the right to request that we:

• Provide you the categories of personal information we have collected or disclosed about you; the categories of sources of such information; the business or commercial purpose for collecting, “sharing” or “selling” your personal information as those terms are defined by the CCPA; the categories of third parties to whom we disclose or “sell” or with whom we “share” personal information; and the categories of personal information we “sell” or “share.”
• Provide access to and/or a copy of certain personal information we have about you.
• Delete certain personal information we have about you.
• Correct inaccurate personal information we have about you.

You may have the right to receive information about the financial incentives that we offer to you, if any. You also have the right to not be discriminated against (as provided for in California law) for exercising certain of your rights referenced herein. Certain information may be exempt from such requests under applicable law. In addition, we need certain types of information so that we can provide our services to you. If you ask us to delete it, you may no longer be able to access or use our services.

To exercise any of these rights, you may submit a request through our online form. You will be required to verify your identity before we are able to fulfill your request. You can also designate an authorized agent to make a request on your behalf. To do so, you must provide us with written authorization or a power of attorney, signed by you, for the agent to act on your behalf. You may still need to verify your identity directly with us.

You also have the right to opt out of “sales” and “sharing” of your personal information as described below.

“Sales” and “Sharing” of personal information. As explained in the “Online Analytics and Advertising” section above, we may provide your information to vendors that perform services to assist us in online advertising activities and in analyzing use of our Marketplace. Under the CCPA, the disclosure of your personal information to these third parties for these purposes may be considered a “sale” or “sharing” of personal information or online targeted advertising.

If you would like to opt out of the disclosure of your information to such third parties through cookies and similar tools for purposes that could be considered “sales” or ‘online targeted advertising' for those third parties' own commercial purposes, please click the ‘Do Not Sell or Share My Personal Information' link in our footer. Note that you will need to opt out on each device you use to access the Marketplace. If you have a legally recognized browser-based opt out preference signal turned on via your device browser, we recognize the preference expressed by such signal in accordance with applicable law.

Retention of Your Personal Information

We will retain your personal information for as long as reasonably necessary to provide the Marketplace and our services or until you delete or modify your information. We also reserve the right to retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

California Shine the Light Disclosure

Under the California Shine the Light Law, if you are a California resident, if relevant, you may ask for a list of third parties that have received your personal information (as defined under the Shine the Light law) for direct marketing purposes during the previous calendar year. Please note that we have not disclosed your personal information with third parties for their own direct marketing purposes.

California Do-Not-Track Disclosure

California law requires us to let you know how we respond to web browser Do Not Track (DNT) signals. Because there currently isn't an industry or legal standard for recognizing or honoring DNT signals, we don't respond to them at this time. Please note that Do Not Track is a different mechanism than the legally recognized browser-based opt out preference signal mentioned above.
